Terms & Conditions

These Terms and Conditions ("Terms") are a legal agreement between you ("Client", "you", or "your") and MasterStuff ("we", "us", or "our"). By using our website design and development services ("Services"), you agree to comply with and be bound by the following terms.

1. Website Owner, the Offering, and Binding of Terms

We, MasterStuff, provide website design and development services to businesses and individuals. By accessing or using our Services, you agree to these Terms. If you do not agree, do not use our Services.

2. Who Can Use MasterStuff; Account Creation

We provide Services to individuals or legal entities who are 18 years of age or older and have the authority to enter into a legal contract. If an account or user dashboard is provided as part of your service, it must be accessed and used only by authorized users.

3. Key Commercial Terms Offered to Customers

We will provide a service agreement outlining:

  • The scope of work

  • Estimated timelines

  • Payment terms

  • Milestones (if applicable)

All fees must be paid in accordance with the agreement before final delivery or transfer of rights.

4. Return and Refund Policy

Due to the nature of digital services, refunds will only be issued under the following conditions:

  • The work has not yet begun, and a refund request is submitted within 30 days of payment.

  • We are unable to deliver the agreed-upon service due to unforeseen circumstances on our part.

All refund requests must be submitted in writing, whether online or offline.

5. Retention of Right to Change Offering

We reserve the right to change, suspend, or discontinue any part of our Services at any time, with or without prior notice, including features, functionality, or pricing.

6. Warranties & Responsibility for Services and Products

We warrant that the Services will be performed in a professional and timely manner. However:

  • We do not guarantee specific performance results (e.g., traffic, sales).

  • We are not responsible for legal compliance of client content or policies.

  • It is the client's sole responsibility to review and approve the final website, including all content, third-party integrations, and legal disclaimers.

7. Ownership of Intellectual Property, Copyrights, and Logos

  • Until final payment is made, all work remains our property.

  • Upon full payment, ownership of the final website files and design is transferred to the client.

  • We retain the right to display the project in our portfolio unless agreed otherwise.

  • We retain the right to use any property that either you give us or from your original website during the website design process.

8. Right to Suspend or Cancel User Account

  • If access to a dashboard, content management system, or service portal is provided, we reserve the right to suspend or cancel access if:

  • There is misuse of the platform

  • There is a breach of these Terms

  • Payments are overdue

9. Indemnification

  • You agree to indemnify, defend, and hold harmless MasterStuff, its employees, and affiliates from any claims, liabilities, or damages arising out of:

  • Your use of our Services

  • Content you provide

  • Failure to comply with applicable laws or third-party policies

10. Limitation of Liability

  • To the fullest extent permitted by law, we will not be liable for:

  • Loss of revenue, profit, or data

  • Business interruption

  • Legal issues caused by your use of the website

  • Issues arising from third-party integrations or platforms

11. Right to Change and Modify Terms

We reserve the right to revise these Terms at any time. Clients will be notified of material changes. Continued use of our Services constitutes acceptance of updated Terms.

12. Promotional Emails and Content

By engaging our Services, you agree to receive occasional promotional content via email. You may opt out at any time by clicking "unsubscribe" in the email footer.

13. Preference of Law and Dispute Resolution

These Terms are governed by the laws of the United Kingdom. Any disputes will be resolved exclusively located in the courts of London, England, UK.

15. Provisions Recommended for Websites With User Communities

If we develop a website that includes forums, user profiles, blogs, or communities, the client is responsible for:

  • Moderation and monitoring of user content

  • Publishing acceptable use policies

  • Ensuring GDPR/CCPA or privacy compliance for user-generated content

We do not moderate or manage any community-related features unless separately contracted to do so.
